Subject matter of the contract
Martina Skvaro sells you the goods ordered exclusively in accordance with the following General Terms and Conditions (GTC). Special agreements are reserved.​

Conclusion of contract
You can order a product listed in the online store of Martina Skvaro Design Studio or äm | äs | ka Design Studio to order a product listed therein. The contract between you and Martina Skvaro is concluded on the basis of your order and the acceptance of the order by Martina Skvaro. You will be informed of the acceptance of your order by e-mail. If you place an order in the online store, you will receive an automatic order confirmation. This merely confirms the completion of the electronic ordering process; the contract is only concluded when Martina Skvaro expressly accepts the order.

Delivery time
Martina Skvaro usually ships items in stock within 1-2 days after receipt of payment. For items that are not in stock at äm | äs | ka Design Studio, you will be informed of the waiting time before you place your order. Martina Skvaro Design Studio or äm | äs | ka Design Studio is currently in the development phase. Martina Skvaro orders small series and not large series. With the exception of purchases from retailers who already require an exact quantity. As the prices and delivery times depend on the material prices and the manufacturing processes, the delivery of items not in stock takes 2-4 or 6-8 weeks. For items marked “pre-order”, a collective order from private individuals will be generated at the end of each month to minimize transport emissions. Thank you for your patience.

Terms of delivery
Martina Skvaro delivers the ordered goods to the address you specify. As a rule, delivery is made by Swiss Post by means of a non-registered parcel. Martina Skvaro will charge you CHF 7.00 for shipping, with the exception of parcels over 10 kg and bulky goods, for which an amount corresponding to the actual additional costs will be charged. Martina Skvaro sends deliveries by Swiss Post. For deliveries abroad, the standard prices of the Swiss postal service apply. (see: https://www.post.ch/en/sending-parcels/international-consignments)

With reference to Art. 185 para. 2 OR, Martina Skvaro states that the benefit and risk for the ordered goods shall pass to the buyer after Martina Skvaro has posted the parcel at the post office. If damage occurs during transportation to you, you must contact the post office immediately after receiving the parcel and report the damage to the post office. The products offered in this store will be delivered within seven working days, provided they are in stock.

Terms of payment
All prices are quoted in Swiss francs (CHF) and include VAT. The ordered goods are generally delivered against prepayment. For custom-made products, the conditions in the order confirmations apply.

Retention of title
The goods ordered shall remain the property of Martina Skvaro until the purchase price has been paid in full. Martina Skvaro shall be entitled to register a corresponding retention of title. If a customer defaults on payment, Martina Skvaro shall have the right to withdraw from the purchase contract.

Right of return
You must check the ordered goods for defects and completeness immediately upon receipt and report any defects to Martina Skvaro in writing or by e-mail, including a photo of the damage, within five days of receipt of the goods. Complaints made at a later date cannot be considered. Martina Skvaro will contact you immediately upon receipt of the notice of defects in order to find a solution for you. Martina Skvaro is entitled to exchange the defective goods for goods free of defects or for a shopping voucher in the amount of the purchase price of the defective goods. Returns without our written consent will not be accepted. The return of ordered and defect-free goods is generally excluded.

Only unused products ordered in the online store may be returned. In this case, the ordered product must be returned to Martina Skvaro in its original packaging within 14 days of delivery to the customer. The customer shall bear the costs of the return shipment.  In this case, the return shipment must be sent to “Martina Skvaro - äm | äs | ka Design Studio, Zeughaus 1, Zeughausstrasse 52, 8400 Winterthur”.

Data protection
Martina Skvaro processes through Martina Skvaro Design Studio resp. 

äm | äs | ka Design Studio processes personal data of customers in strict compliance with the applicable data protection law. Visits to my online store are recorded and I reserve the right to evaluate the data collected. However, all data is treated with absolute confidentiality and used to process orders. Customer data will only be made accessible to third parties to the extent necessary to process orders and payment transactions. For online orders in particular, this also includes the transfer of payment data to financial service providers.

Place of performance, place of jurisdiction and applicable law
These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law. With the acceptance of your order by Martina Skvaro, a purchase contract within the meaning of Art. 184 ff. of the Swiss Code of Obligations is concluded. Unless otherwise stipulated in these provisions, the provisions of the Swiss Code of Obligations shall apply. The place of jurisdiction is 8400 Winterthur.

Final provisions
The GTC of Martina Skvaro applicable at the time of conclusion of the contract shall apply to the contractual relationship. These shall also apply in particular if they differ from those of the customer. Should individual provisions of these GTC be or become invalid, this shall not affect the legal validity of the remaining provisions.
